Terms of Engagement
01 — Nature of Engagement
Forensic Capital provides independent post-incident and structural forensic research on DeFi protocols. Reports are forensic intelligence documents. They are not legal advice, financial advice, investment recommendations, or audit certifications. Findings are based on publicly available data as of the date of analysis and do not constitute a guarantee of completeness or accuracy beyond that date.
02 — Scope of Work
Scope is defined in writing before any work begins, via a scoping brief confirmed by both parties. Work covers only what is stated in the confirmed scope. Forensic Capital conducts research exclusively on publicly observable data — no system intrusion, no credential access, no interaction with private or internal systems (see Methodology).
03 — Delivery and Payment
Reports are delivered on a delivery-validation basis: the complete report is delivered to the client before any payment is due. The client reviews the full document, and payment is requested only after the client confirms delivery and acceptance.
If the delivered report contains no actionable finding beyond what the client’s prior audits had already identified, no payment is owed.
- Rapid Triage: delivered within 48 hours of scope confirmation.
- Standard: delivered within 72 hours of scope confirmation.
- A Rapid Triage amount is credited in full toward a Standard report commissioned within 30 days.
Accepted payment methods: bank transfer (IBAN provided on quote) or Stripe (card or payment link). Payment is due upon acceptance after review, unless otherwise agreed in writing.
VAT: Forensic Capital provides services exclusively to business clients (B2B). No VAT is charged or collected on any engagement. Clients responsible for applicable self-assessment or reverse-charge obligations under their local jurisdiction.
04 — Revisions
Standard engagements include one revision round within 7 days of delivery. Revisions cover clarification and correction of the delivered content; they do not extend the confirmed scope.
05 — Intellectual Property and Rights
Upon full payment, the client receives full commercial rights to the delivered report, perpetual and transferable. All content published on forensic-capital.com — public reports, analyses, code, graphics, and marks — remains the exclusive property of Forensic Capital. Reproduction of published site content, even partial, without prior written authorization is prohibited.
06 — Confidentiality
Engagements are covered by a bilateral non-disclosure agreement on request. Commissioned results are not disclosed by Forensic Capital without the client’s written authorization. Published reports listed on the site are public record.
07 — Limitation of Liability
Forensic Capital’s total liability under any engagement is limited to the amount paid for that engagement. Forensic Capital is not liable for decisions, claims outcomes, or losses arising after delivery. Reports document observable facts and structural analysis; they do not guarantee any incident outcome.
08 — Independence
All research is independent. Forensic Capital is not commissioned for market positioning for or against any protocol analysed. Commissions are accepted as independent research only.
09 — Governing Law
These terms are governed by the laws of the State of Delaware, USA. Any dispute arising from these terms or any engagement shall be subject to the courts of the State of Delaware.
Privacy & Data Handling
01 — Principle
Forensic Capital minimises data collection. The site uses no tracking cookies, no tracking pixels, and no third-party advertising analytics.
02 — Visitor Data
During normal browsing, no personal data is collected by Forensic Capital for marketing or profiling purposes. No tracking cookies or pixels are set. No visitor data is sold or shared.
Note on hosting: the site is served via Hostinger VPS. Like any web server, the hosting provider may process technical server logs (including IP addresses) for security and operational purposes. These logs are not used by Forensic Capital for tracking or profiling. See Hostinger’s privacy policy for their processing.
03 — Contact Data
If you contact Forensic Capital by email, your email address and the content of your message are processed solely to respond to your inquiry and to manage any resulting engagement. This data is not sold, shared, or used for unrelated commercial purposes.
04 — Payment Data
Payments are processed by Stripe or by bank transfer. Forensic Capital does not store card numbers. Card and payment data are processed by Stripe under its own privacy terms and PCI-DSS compliance. Bank transfer details are retained only as required for accounting and legal obligations.
05 — Data Retention
Contact and engagement data are retained only as long as necessary to manage the engagement and to meet legal and accounting obligations, then deleted.
06 — Your Rights (GDPR / CCPA)
Forensic Capital aims to handle data in a manner compatible with GDPR and CCPA. You have the right to access, correct, and request deletion of personal data held about you, and to object to its processing. To exercise these rights, contact: marcus@forensic-capital.com. Requests are answered within the statutory period.
07 — Cookies
The site uses only essential cookies required for basic function, if any. No non-essential or tracking cookies are set, so no cookie consent banner is required.
